1. Privacy Policy – Introduction. The following describes the privacy policy (as amended or otherwise changed from time to time, the “Privacy Policy”) applicable to the services available through the Grillo’s Pickles, Inc. website, the Grillo’s Pickles, Inc. mobile site, and other mobile applications and any other online communications and interfaces (the “Site”) from Grillo’s Pickles, Inc.. Grillo’s Pickles, Inc. and its subsidiaries, affiliates, agents, assigns, successor (“we”, “us” or “Company”) are committed to respecting the privacy rights of the users of the Site and its related services, software, purchasing of products in connection with the site (“Services”).
By accessing, using, registering, or otherwise accessing Services connected with Company providing access and content to the Site, you agree to this Privacy Policy and the Terms of Service, and consent to the collection, use, and processing of your Personal Information in accordance with this Privacy Policy. If you do not agree with this Privacy Policy, please do not visit, use, register or otherwise access any part of this Site or Services. The Terms of Service is incorporated herein by reference and made a part of this Privacy Policy.
On occasion Grillo’s Pickles, Inc. may revise this Privacy Policy, including to address changes in the law, our Personal Information collection and use practices, the features of our Site, and/or advances in technology. If we make any material changes, we will notify you by email (sent to the email address specified in your account) or by posting a revised policy on our Site. Your continued use of our Site will be deemed your agreement that your information may be used in accordance with the new policy. If you do not agree with the changes, then you should stop using the Site and notify us that you do not want your information used in accordance with the changes.
2. INFORMATION WE COLLECT
When you use our Services, we may collect, store, and process various kinds of data, including Personal Information about you. “Personal Information” includes information that can identify you as a specific individual, such as your name, address, phone number, credit card number, or email address. We also collect non-personally identifiable information, including your IP address, search preferences related to specific searches, location, and bids through your interactions with our Site. When we link non-personally identifiable information with Personal Information, we will treat it as Personal Information under this Privacy Policy.
- (a) TRAFFIC DATA COLLECTED. The Site automatically tracks and collects the following categories of information: (1) IP addresses; (2) domain servers; (3) types of computers accessing the Site; and (4) types of web browsers used to access the Site; and (5) Internet or other electronic network activity information: such as browsing history, search history, and information regarding your interactions with the Site, and content (collectively “Traffic Data”).
- (b) PERSONAL INFORMATION COLLECTED. In some parts of the Site, in order for you to access the Services, we may require you to provide us with Personal Information. Personal Information includes the following categories of information: (1) Contact Data (such as your name, mailing address, and email address) and any other similar identifiers; (2) Financial Data (such as your account or credit card number); (3) Demographic Data (such as your zip code, age, and income); (4) If you communicate with us by email, post messages, or otherwise complete online forms, any information provided in such communication may be collected as Personal Information; (5) data regarding purchases or sales that you provide in a transaction, shipping, billing, and other information you provide, as well as information required for customs clearance (such as tax identification numbers or other identification numbers) and relevant shipping information (such as shipment numbers and tracking information) if shipped through one of our programs; (6) additional information through a web form or by updating or adding information to your account or contacting us; (7) other data that we are required or entitled by applicable law to collect and process and that we need for your authentication or identification, or for the verification of the data we collect; (8) data regarding all other interactions with our Services, your advertising preferences, and your communications with us; (9) location data, including your general location data (e.g., IP address) and the precise location data of your mobile device; (10) computer and connection information, such as statistics regarding your use of Services, information on data traffic to and from websites, referral URL, information on advertisements, your IP address, your access times, your browser history data, your language settings and your weblog information; (11) data about the pages you visit, the access time, frequency and duration of visits, the links on which you click and other actions you take as part of your use of our Services and in advertising and email content; (12) the IP address from which your device accesses the Services; (13) data about you from other sources and from third parties to the extent permitted by applicable law. In particular, this includes the following data: Data from public sources (e.g. demographic data) Data from credit agencies or bureaus (e.g. credit reports/checks, identity confirmation, data for risk modeling and setting of credit limits).
- (c) CHILDREN’S INFORMATION. We do not knowingly collect, maintain, or use Personal Information from our Site from children under the age of 18. We request that persons under the age of 18 not use the Site without supervision from a responsible adult. We will never knowingly request Personal Information from a child under the age of 18 without verifiable parental consent. If we learn we have collected or received Personal Information from a child under 18 without verification of parental consent, we will delete that information. 3. THIRD-PARTY WEBSITES.
Our Site may include links to other websites and online services whose privacy practices may differ from those of Grillo’s Pickles, Inc.. While we seek to link only to sites that share our high standards and respect for privacy, we are not responsible for the privacy practices other websites. By accessing other third-party websites or applications through our Site, you are consenting to the terms and privacy policies of those websites. If you submit personal information to or through any of those web sites or services, your information is governed by their privacy policies. We encourage you to carefully read the privacy policy of any website you visit or online services you use.
Company may maintain accounts on third-party websites, such as social media sites, as tools to better interact with our Site visitors. Your activity on those third-party websites is governed by the security and privacy policies of those sites. Users of third-party websites are often sharing information with the general public, user community, and/or the third-party operating the website and information may be used in a variety of ways. Our Site may include social media features related to Facebook, Instagram, X (formally Twitter), YouTube, TikTok, etc. These social media features may require cookies to be set to function properly. While we do not sell your Personal Information for money, we may share your information for the following purposes:
- Compliance with Law and Other Disclosures: Company reserves the right to release Personal Information in order to comply with applicable law and when we believe that disclosure is necessary to comply with a judicial proceeding, court order, legal process, or to prevent harm or financial loss, or to investigate same. We may also release Personal Information to enforce or apply the Terms of Service applicable to our products and services, protect us or others against fraudulent or inappropriate activities, or otherwise protect the rights, property or safety of Company, our affiliated companies, our customers, or others. We reserve the right to report to law enforcement agencies any activities that we in good faith believe to be unlawful, as determined in our sole discretion.
- Third-Party Service providers and suppliers: Company may contract with third-party service provides and suppliers to deliver products, services, and customer solutions. We provide some of our Services through contractual arrangements with affiliates, services providers, partners and other third parties (collectively, “Service Partners”). Our Service Partners may use your Personal Information to operate the Site and to deliver their services. For example, your data may be transferred to website hosting partners and other parties who assist us in designing and operating the website. Please be aware that limiting use of or deleting your Personal Information may impact features and uses that rely on that Personal Information.
7. RETAINING PERSONAL INFORMATION.
We keep your Personal Information for as long as is necessary for the purposes for which it is processed or until required or permitted by law. These periods vary depending on the nature of the information and your interactions with us. When the purposes for which we process your Personal Information have concluded, we will either permanently delete or destroy the relevant Personal Information or de-identify it, in a manner that ensures individuals are no longer identifiable. You may, however, request information about how long we keep a specific type of information, or request that Company delete your Personal Information by contacting us in the methods described above. If required by law, Company will grant a request to delete information, but you should note that in some situations we must keep your Personal Information to comply with Company’s legal obligations, resolve disputes, enforce Company agreements, or for another one of Company’s business purposes.
8. LOST OR STOLEN INFORMATION.
You must promptly notify us if your credit card, username, or password is lost, stolen, or used without permission. In such an event, we will remove that credit card number, username, or password from your Account and update our records accordingly.
9. UPDATES AND CHANGES TO PRIVACY POLICY.
We reserve the right, at any time and without notice, to add to, change, update, or modify this Privacy Policy, simply by posting such change, update, or modification on the Site and without any other notice to you. Any such change, update, or modification will be effective immediately upon posting on the Site. We will revise the “last updated” date found at the beginning of this Privacy Policy when we post changes to it. Your continued use of our Site will be deemed your agreement that your information may be used in accordance with the new policy. If you do not agree with the changes, then you should stop using the Site and notify us that you do not want your information used in accordance with the changes.
10. ADDITIONAL RIGHTS FOR CALIFORNIA RESIDENTS.
The CCPA provides California residents with the following additional rights.
Right to Know: California residents may request disclosure of the specific pieces and/or categories of Personal Information that the business has collected about them, the categories of sources for that Personal Information, the business or commercial purposes for collecting the information, the categories of Personal Information that we have disclosed, and the categories of third parties with which your Personal Information was shared.
If you would like to manage, change, limit, or delete your Personal Information, you can do so through your Company account settings. Alternatively, you can exercise any of the rights above by contacting us by submitting a message to us as provided for above. Once you contact us to exercise any of your rights, we will confirm receipt of your request.
Please be aware that limiting use of or deleting your Personal Information may impact features and uses that rely on that Personal Information. However, we will not discriminate against you for exercising any of your rights. If you need further assistance, you can contact us through one of the channels listed above. We will respond to your request within a reasonable timeframe.
Your identity will need to be validated before we are able to process any of the requests described in this Section, and in our discretion, deny your request if we are unable to verify your identity. As a part of this process, government or other identification may be required. You may designate an authorized agent to make a request on your behalf. In order to designate an authorized agent to make a request on your behalf, the requester’s valid government issued identification, and we may verify the authenticity of the request directly with you.
The CCPA requires disclosure of the categories of personal information collected over the past 12 months. While this information is provided in greater detail in the Section 2, the categories of Personal Information that we have collected are:
- Identifiers, including name, email address, shop name, IP address, and an ID or number assigned to your account.
- Other individual records such as phone number, billing address, or credit or debit card information. This category includes personal information protected under pre-existing California law (Cal. Civ. Code 1798.80(e)), and overlaps with other categories listed here.
- Demographics, such as your age or gender, or, where you have provided such information to Company voluntarily, demographic information about your race, ethnicity, sexual orientation, or gender identity, provided in relation to specific marketing and advocacy projects and campaigns. This category includes data that may qualify as protected classifications under other California or federal laws.
- Commercial information, including purchases and engagement with the Services.
- Internet activity, including your interactions with our Services and what led you to our Services.
- Sensory visual data, such as pictures posted on our Service.
- Location data provided through location enabled services such as WiFi and GPS.

Any request to access your personally identifying information will be answered in less than 30 days. If you have registered your profile on any of the services available on our Site, your email address and password are required in order to access your profile information.
